Julie Burnstein, a trial lawyer, represents both plaintiffs and defendants in commercial and business litigation matters, with an emphasis on business to business disputes, including business torts, real estate and and trade secret and covenant not to compete litigation. Julie was named to Business Tennessee's 2007 "150 Best Lawyers" for business litigation and listed as a "Rising Star" in Benchmark: Litigation 2008 for her commercial and business litigation practice. She also was listed in VerdictSearch Top 100 Jury Verdicts of 2004 and the National Law Journal's Top 100 Verdicts of 2004 (26.5 million verdict against HCA subsidiary). She maintains an AV rating from Martindale Hubble and is listed in both the Best Lawyer's in America 2008 and the Nashville Business Journal Best of the Bar 2008 for commercial litigation. Julie has represented clients in cases in various jurisdictions, including Tennessee, Mississippi, Kentucky, Oklahoma and Texas.
Julie has represented clients in various types of commercial and business litigation matters, including matters concerning misappropriation of trade secrets, business torts, breach of contract, insurance coverage, defamation and covenants not to compete. She represented a group of sellers in opposing claims for breach of a covenant not to compete contained in an asset purchase agreement, misappropriation of trade secrets and interference with business relations. After extensive discovery and motion practice, the case resolved favorably. Julie tried, to a favorable verdict, a misappropriation of trade secrets and breach of fiduciary duty case arising from a former employee's theft of a customer list. She has regularly represented an aircraft broker and obtained a favorable verdict in a trial arising from a dispute over a commission and successfully defended the company against claims for breach of contract, conversion and breach of fiduciary duty.
Julie has experience in representing clients in the healthcare industry. She has served as lead counsel in several litigated matters arising from the purchase or sale of assets by health care companies. Julie has also represented clients in connection with physician disputes. She successfully litigated to judgment a matter applying the Tennessee Supreme Court's recent decision in Murfreesboro Medical Clinic, P.A. v. Udom, 166 S.W.3d 674 (Tenn. 2005) declaring physician covenants not to compete unenforceable. She was named an "Outstanding Healthcare Litigator" by Nightingale Healthcare News in 2007.
She also maintains a real estate litigation practice. She has experience representing owners, contractors, subcontractors and suppliers in litigation and arbitration. For several years, Julie represented general contractors throughout Tennessee in exterior insulation finish system (EIFS) litigation. She has defended a concrete manufacturer in a class action which resulted in one of the first decisions interpreting the Class Action Fairness Act of 2005 and in which the court ultimately denied class certification. Julie has represented clients in easement and nuisance disputes and successfully tried adverse possession cases.
Julie is a member of the Nashville, Tennessee and American Bar Associations, the American Bar Association's Forum on the Construction Industry and the Nashville Bar Association's and Tennessee Bar Association Corporate Counsel Committee. She is the 2009 Chair for the Nashville Bar Association's Chancery and Circuit Court Committee of Court.
